Service, Open File Discovery, & Judge’s Response

OSC must serve the Judge with the Notice of Hearing (service issues prolong the process) (5-14 days)
OSC has 30 days to prepare and send to the Judge non-privileged info in OSC files
Judge has 30 days to respond to the Notice of Hearing (often requests extension)

Hearing Officer Appointment

Hearing Officer must be randomly assigned
Must accept appointment by returning the signed acceptance letter
Must schedule & hold a conference call with the parties (scheduling conflicts could cause delay) (5-30 days)
Sends the Case Management Order to the parties (10-20 days)

NOTE: The Commission encourages the Hearing Officer to complete the hearing within 90 days of the Notice of Hearing filing. Service complications, requests for extension and continuances (often from the judge) prevent this aspirational time goal.
